These Terms of Service ("Terms") govern your use of Text George, a product of HelpMe, Inc. ("HelpMe," "we," "us," or "our"). By texting our number or using textgeorge.com, you agree to these Terms. These Terms include a binding arbitration agreement and a class action waiver, which affect how disputes between us are resolved. Please read that section carefully.
Text George is not an emergency service. If there is a threat to life, health, or property, call 911 or your local emergency number immediately. Do not use Text George to report or respond to a medical emergency, fire, gas leak, carbon monoxide, downed power line, crash, or crime in progress. We do not monitor messages continuously and cannot dispatch emergency responders.
Text George is a text-based concierge. You describe a problem; we conduct a conversational intake and, once you give us the go-ahead, identify and contact local service providers on your behalf. Providers perform the actual work. We facilitate the connection and nothing more. We are not a contractor, broker, employment agency, lawyer, doctor, insurer, or agent of either you or any provider.
Text George is automated. "George" is an AI assistant, not a human being. Your conversation is handled by software using AI language models, and providers are contacted by an automated voice agent and by automated text messages. At the start of each call our voice agent states that it is an AI agent and that the line is recorded, and calls we place to providers are recorded and transcribed so we can confirm what was agreed. Automated systems make mistakes. AI-generated summaries, quotes, scopes of work, and provider details may be incomplete or wrong. Use your own judgment before relying on anything we tell you, and confirm the important details directly with the provider.
You must be at least 18 years old and able to enter into a binding contract to use Text George. The service is offered only in the United States. We may decline any request for any lawful reason, including requests that are illegal, unsafe, outside the areas we can serve, or outside what we handle.
Text George is free to use. We do not charge you for finding recommendations, contacting providers on your behalf, gathering quotes, or making reservations, and we will never ask you for payment information. Any amount for the actual work is agreed between you and the provider directly, and paid to them — we are not a party to that transaction, and nothing we send is a deposit toward or an estimate of what a provider will charge you.
If something goes wrong, email us. Whether the job was never filled, the details we sent were wrong, or something else went sideways, write to support@textgeorge.com and we will look at it and make it right where we should.
We normally contact providers during standard business hours at your location (roughly 9 AM to 6 PM local time, Monday through Friday, excluding major U.S. holidays), and where a provider publishes its own hours we aim to contact them while they are open. If your request comes in outside those hours, including weekends and holidays, we will ask whether it is an emergency: urgent requests are worked immediately, including outreach to providers offering 24/7 or after-hours service; otherwise outreach begins on the next business day. Provider availability and response times are outside our control.
We will make a genuine effort to find and contact suitable providers, but we do not guarantee that any provider will accept your job, respond to you, show up, complete the work, charge a particular price, or meet a particular standard of quality or timing. We do not perform background checks, license verification, insurance verification, or bonding checks on providers. Information we share about a provider, including ratings, reviews, hours, and prices, comes from public sources and may be out of date or inaccurate. Including a provider is not an endorsement, recommendation, or warranty of that provider. Choosing, hiring, supervising, and paying a provider is entirely your decision and your responsibility.
By initiating contact with Text George, you consent to receive transactional text messages about your request. Message frequency varies by request. Message and data rates may apply. Reply STOP to opt out. Reply HELP for assistance at support@textgeorge.com.
You agree to provide accurate information about your request, your location, and your contact details, and to keep your dealings with providers lawful and civil. You agree not to use Text George to request anything illegal, to harass anyone, to impersonate another person, to submit someone else's personal information without their permission, or to interfere with or attempt to reverse engineer the service. You are solely responsible for your interactions and agreements with any provider we connect you with, including anything that happens on your property.
You keep ownership of the photos, descriptions, and other content you send us. You grant HelpMe a non-exclusive, royalty-free license to use, copy, store, and transmit that content for the purpose of operating the service, which includes forwarding it to service providers so they can understand and quote the job. You confirm that you have the right to send us the content you send and that sharing it with a provider will not infringe anyone's rights or privacy. Do not send us content you are not comfortable having passed to a provider, and do not send sensitive information we have not asked for.
The service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, HelpMe disclaims all implied warranties, including any warranty of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the service will be uninterrupted, timely, secure, error-free, or that any result will be obtained. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
To the fullest extent permitted by law, HelpMe and its officers, directors, employees, and agents are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising from or relating to your use of the service, whether based in contract, tort, negligence, strict liability, or otherwise, even if we have been advised of the possibility of those damages.
Our total liability to you for all claims relating to the service is limited to one hundred U.S. dollars ($100).
We are not liable for the acts or omissions of any service provider, including the quality, safety, legality, or timeliness of their work, any property damage or injury, or any dispute between you and them. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for our own fraud, gross negligence, or willful misconduct.
You agree to indemnify and hold harmless HelpMe and its officers, directors, employees, and agents from any claim, demand, loss, liability, or expense, including reasonable attorneys' fees, arising from your use of the service, your breach of these Terms, the content you send us, or your dealings with any service provider.
Please read this section carefully. It affects your rights, including your right to bring a lawsuit in court and to participate in a class action.
Talk to us first. If you have a problem, email support@textgeorge.com with a description of it and what you would like us to do. We will try in good faith to resolve it informally. Both of us agree to attempt this for at least 30 days before starting a formal proceeding.
Binding arbitration. If we cannot resolve a dispute informally, you and HelpMe agree that any dispute, claim, or controversy arising out of or relating to these Terms or the service will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except as stated below. The arbitration will be conducted in the county where you live or, at your option, by telephone, video, or on written submissions. The arbitrator's decision may be entered as a judgment in any court of competent jurisdiction. This agreement to arbitrate is governed by the Federal Arbitration Act.
Class action waiver. You and HelpMe agree to bring claims only in an individual capacity. Neither of us will bring or participate in a class, collective, consolidated, or representative action, and the arbitrator may not consolidate claims or preside over any form of representative proceeding. If this waiver is found unenforceable as to a particular claim or remedy, that claim or remedy will be severed and heard in court, and the rest of this section will still apply.
Exceptions. Either of us may bring an individual claim in small claims court if it qualifies, and either of us may seek injunctive relief in court to protect intellectual property or to stop unauthorized access to the service.
Your 30-day right to opt out. You may reject this arbitration and class action waiver by emailing support@textgeorge.com with the subject line "Arbitration Opt-Out," together with the phone number you use with Text George, within 30 days of first agreeing to these Terms. Opting out has no other effect on your use of the service, and we will not treat you differently for it.
These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. To the extent any dispute is not subject to arbitration, you and HelpMe agree to the exclusive jurisdiction of the state and federal courts located in San Francisco, California, and waive any objection to venue there. Nothing here deprives you of the protection of mandatory consumer protection laws in the state where you live.
You can stop using Text George at any time, and replying STOP ends our messages to you. We may suspend or end your access at any time if you breach these Terms, if we suspect fraud or abuse, or if we stop offering the service. Sections that by their nature should survive, including disclaimers, limitation of liability, indemnification, and dispute resolution, survive termination.
We may update these Terms from time to time. When we make a material change we will update the date at the top of this page. Continued use of the service after changes constitutes acceptance. If you do not agree to a change, stop using the service.
These Terms, together with our Privacy Policy, are the entire agreement between you and HelpMe about the service. If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and HelpMe, or between HelpMe and any service provider, each of which is an independent business.
